These Terms and Conditions (“Terms”) govern your access to and use of this website and any products, programs, coaching services, digital content, subscriptions, artificial intelligence services, or other services supplied by Cedia Media Pty Ltd trading as Cody Butler, Better Marriage and/or Comeback Culture (“Provider”, “we”, “us” or “our”).
By purchasing, accessing, or using any of our products or services, you agree to these Terms.
If you do not agree to these Terms, you must not purchase, access, or use our products or services.
You confirm that you are legally capable of entering into a binding agreement.
We may update these Terms from time to time. The version applicable to a particular transaction will be subject to applicable law and the terms presented to you in connection with that transaction.
1. The Provider
For the purposes of these Terms:
“Provider” means Cedia Media Pty Ltd, including where it trades or operates under the brands Cody Butler, Better Marriage, Comeback Culture, Win Your Wife Back, Coach Cody AI, or other associated brands.
“Client” or “User” means any person purchasing, accessing, or using a product or service supplied by the Provider.
“Coach Cody AI” means the artificial intelligence-based conversational guidance service offered under the Coach Cody AI name, including its chat, voice, and related functionality.
2. Nature of Coaching Services
Coaching is an educational and developmental process intended to assist clients in developing greater understanding, awareness, personal responsibility, communication skills, and decision-making ability.
Coaching is not therapy, counselling, psychotherapy, medical treatment, legal representation, financial advice, or another regulated professional service.
The Client remains responsible for their own decisions, behaviour, communications, actions, omissions, and outcomes.
3. No Guarantee of Results
Relationships involve multiple people and circumstances outside the Provider’s control.
The Provider does not guarantee:
Reconciliation.
Prevention of separation or divorce.
Restoration of a marriage.
Changes in another person's feelings or behaviour.
Any specific relationship outcome.
Any particular financial, personal, emotional, or other result.
Testimonials, examples, case studies, and previous client outcomes are illustrative only and do not constitute a guarantee that another Client will achieve similar results.
4. Coaching Is Not Medical or Mental Health Treatment
Our coaching, training, programs, content, and artificial intelligence services are not intended to diagnose, prevent, treat, or cure any psychological, psychiatric, medical, or emotional condition.
Nothing provided by the Provider should be treated as a substitute for appropriate professional care where such care is required.
COACH CODY AI
5. Nature of Coach Cody AI
Coach Cody AI is an artificial intelligence software service designed to provide educational information, general relationship guidance, reflection, and decision-support based primarily on Cody Butler's principles, methodologies, training materials, and other information made available to the system.
Coach Cody AI is software.
It is not Cody Butler personally, and interacting with Coach Cody AI does not constitute a private coaching session with Cody Butler or create a personal coach-client, therapist-client, solicitor-client, doctor-patient, fiduciary, or other professional relationship.
Coach Cody AI may be accessed through text chat, voice conversation, or other interfaces made available from time to time.
6. Artificial Intelligence Limitations
The User acknowledges that artificial intelligence has inherent limitations.
Coach Cody AI operates primarily from:
Information supplied by the User.
Information included in its underlying knowledge base.
Patterns and relationships identified by artificial intelligence systems.
It does not independently observe your marriage, your spouse, your family, or events occurring outside the information available to it.
Accordingly, Coach Cody AI cannot know what another person is thinking or feeling.
It cannot reliably determine:
Your wife's motives.
Her intentions.
What she is privately thinking.
What she is privately feeling.
Why she performed a particular action.
Whether she will change her mind.
What she will do next.
Whether reconciliation will occur.
Whether a marriage will survive.
The future outcome of any relationship.
Where Coach Cody AI discusses another person's possible motivations, intentions, thoughts, emotions, or future behaviour, these should be understood as possibilities or interpretations rather than established facts.
The User agrees not to treat such interpretations as certainty.
7. AI May Be Wrong
Artificial intelligence systems can produce information that is:
Incorrect.
Incomplete.
Outdated.
Misleading.
Based on incorrect assumptions.
Based on incomplete information supplied by the User.
Inappropriate for a particular situation.
Coach Cody AI may misunderstand the User, misunderstand the circumstances described, or generate a response that should not be followed.
The fact that a response is presented confidently does not mean that the response is correct.
The User is responsible for independently evaluating information before acting upon it.
8. Coach Cody AI Is Decision-Support — Not Decision-Making
Coach Cody AI is intended to assist Users in thinking through situations and understanding relevant relationship principles.
It does not assume responsibility for the User's decisions.
The User remains solely responsible for deciding:
What they say.
What they send.
Who they contact.
When they communicate.
How they behave.
Which options they pursue.
Whether they accept or reject information provided by Coach Cody AI.
The User should exercise their own judgement and consider the specific circumstances surrounding any decision.
9. No Professional Advice Through Coach Cody AI
Coach Cody AI does not provide legal, medical, psychological, psychiatric, financial, accounting, tax, therapeutic, or other regulated professional advice.
Information provided by Coach Cody AI must not be relied upon as a substitute for advice from an appropriately qualified professional where professional advice is required.
This applies even if Coach Cody AI produces a response concerning one of these subjects.
10. Emergency and High-Risk Situations
Coach Cody AI is not an emergency response service.
It should not be relied upon in circumstances involving an immediate threat to a person's safety, serious violence, abuse, medical emergencies, self-harm, suicide, or another situation requiring emergency or specialist intervention.
The service is not designed to monitor Users continuously or intervene in real-world events.
11. User Responsibility for Information Provided to Coach Cody AI
The usefulness of Coach Cody AI depends substantially upon the accuracy and completeness of the information supplied by the User.
The User acknowledges that:
Coach Cody AI generally sees only the User's description of events.
The User's interpretation may itself be incomplete or inaccurate.
Important context may be unavailable to the system.
Coach Cody AI cannot independently verify most statements made to it.
The User remains responsible for determining whether information generated by Coach Cody AI is appropriate to their circumstances.
12. Third-Party Artificial Intelligence Technology
Coach Cody AI may operate using software, infrastructure, artificial intelligence models, hosting services, voice technology, or other technology supplied by third parties.
The availability and functionality of Coach Cody AI may therefore depend upon services outside the Provider's direct control.
The Provider does not guarantee uninterrupted or error-free availability of Coach Cody AI.
Features may be modified, replaced, upgraded, suspended, or discontinued where reasonably necessary to maintain or improve the service or where required because of changes to third-party technology.
Any handling of personal information remains subject to the Provider's Privacy Policy and applicable privacy law.
13. Coach Cody AI Subscription
Unless otherwise specified at checkout, Coach Cody AI is provided as a recurring subscription.
The current advertised subscription price may be displayed in United States dollars or another currency specified at checkout.
Where the subscription is offered at USD $197 per month, the User authorizes the Provider or its payment processor to charge USD $197 each billing period until the subscription is cancelled.
This is separate from installment payment arrangements for fixed-price coaching programs.
A Coach Cody AI subscription is a subscription service and should not be confused with a payment plan used to pay a fixed program fee over time.
14. Coach Cody AI Cancellation
A User may cancel a cancel-anytime Coach Cody AI subscription in accordance with the cancellation method made available for the subscription.
Cancellation prevents future subscription renewals after the cancellation becomes effective.
Unless otherwise expressly stated as part of a refund or money-back guarantee applicable to the purchase, cancellation does not retrospectively refund subscription periods already purchased or used, except where required by applicable law.
Access may continue until the end of the period already paid for unless otherwise stated at the time of cancellation.
15. Coach Cody AI Availability
We intend to make Coach Cody AI available on an ongoing basis but do not guarantee that the software will always be available.
Temporary interruptions may occur due to:
Maintenance.
Software updates.
Technical faults.
Internet outages.
Third-party service interruptions.
Artificial intelligence provider outages.
Security concerns.
Events beyond our reasonable control.
Features and functionality may evolve as the software develops.
16. Acceptable Use of Coach Cody AI
Users must not intentionally use Coach Cody AI:
For unlawful purposes.
To threaten, harass, abuse, stalk, or harm another person.
To impersonate another person.
To circumvent security or access restrictions.
To interfere with the operation of the service.
To reverse engineer or improperly extract proprietary systems, prompts, training materials, methodologies, or software.
To reproduce, resell, sublicense, or commercially distribute access without written permission.
Access may be restricted or terminated where the Provider reasonably believes the service is being misused.
GENERAL TERMS
17. Client Responsibility
The Client acknowledges that they remain responsible for their own:
Well-being.
Decisions.
Choices.
Communications.
Behaviour.
Actions.
Omissions.
Results.
Information received through coaching, courses, training, digital products, or Coach Cody AI is provided to assist the Client's thinking and development.
The Client determines what information, if any, they choose to apply.
18. Liability
To the maximum extent permitted by applicable law, the Provider, its directors, officers, employees, contractors, agents, affiliates, and service providers will not be liable for losses arising solely from a Client's decision to act or not act upon coaching, educational material, digital content, or artificial intelligence-generated information, except to the extent liability cannot lawfully be excluded or limited.
In particular, the Provider does not assume responsibility for:
Decisions made by the Client.
Communications made by the Client.
The actions or reactions of a spouse or other third party.
Relationship breakdown or reconciliation outcomes.
A User treating AI-generated interpretations as established facts.
Predictions or assumptions made by the User based upon information generated by Coach Cody AI.
Errors, omissions, or inaccuracies produced by artificial intelligence technology.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, remedy, or liability that cannot lawfully be excluded, restricted, or modified.
19. Limitation of Liability
To the maximum extent permitted by applicable law, where liability can lawfully be limited, the Provider's aggregate liability arising from a particular product or service will not exceed the amount paid by the Client for that product or service giving rise to the claim.
This limitation does not apply to liability that cannot legally be excluded or limited.
20. Indemnity
To the extent permitted by applicable law, the Client agrees to indemnify the Provider and its directors, officers, employees, contractors, and agents against third-party claims, losses, costs, or expenses arising directly from the Client's unlawful conduct, misuse of the services, infringement of another person's rights, or material breach of these Terms.
This provision does not require the Client to indemnify the Provider for matters for which the Provider is legally responsible.
21. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, remedy, or other protection available under the Australian Consumer Law or any other applicable law where that right cannot lawfully be excluded.
Where Australian Consumer Law applies, statutory consumer rights operate in addition to these Terms.
22. Confidentiality
Information shared directly with a human Coach will be treated as confidential subject to:
Applicable law.
Court orders.
Legal obligations.
Safety considerations.
The terms of the Provider's Privacy Policy.
Information entered into Coach Cody AI may be processed electronically and may pass through technology providers required to deliver the service.
Users should avoid entering information they do not wish to have processed through an online artificial intelligence service.
Treatment of personal information is governed by the Provider's Privacy Policy and applicable law.
23. Recordings
Coaching calls, group calls, training sessions, or other sessions may be recorded where permitted and disclosed.
Recordings and associated intellectual property remain the property of the Provider unless otherwise agreed in writing.
The Provider's use of recordings remains subject to applicable privacy, confidentiality, consent, and other legal requirements.
24. Intellectual Property
All intellectual property associated with the Provider's programs and services remains owned by or licensed to the Provider.
This includes, without limitation:
Videos.
Training.
Frameworks.
Course materials.
Worksheets.
Documents.
Audio.
Coaching methodologies.
Prompts.
Artificial intelligence configuration.
Coach Cody AI content and underlying proprietary materials.
Branding and other original material.
Purchasing a product grants the Client a personal, limited, non-transferable right to use the material for their own purposes.
Clients may not copy, reproduce, publish, sell, sublicense, distribute, share, scrape, repurpose, or commercially exploit protected material without written permission.
25. Reliance on Materials
Information supplied through the Provider's websites, programs, coaching, courses, publications, emails, videos, artificial intelligence systems, or other materials is educational in nature.
It should not be relied upon as legal, medical, psychological, financial, or other regulated professional advice.
26. Fixed-Price Programs and Payment Plans
Where a coaching program, training program, or other fixed-price service is purchased using installments, the installments are a payment arrangement for the total purchase price rather than a cancel-anytime subscription.
By selecting such a payment plan, the Client agrees to pay the full program fee according to the agreed payment schedule, subject to rights and remedies that cannot lawfully be excluded.
Stopping participation or choosing not to use the program does not by itself convert a fixed-price commitment into a cancel-anytime subscription.
This section does not apply to services expressly sold as recurring subscriptions, including Coach Cody AI where it is offered on a monthly subscription basis.
27. Authorization of Payments
By purchasing a fixed-price payment plan or recurring subscription, the Client authorizes the Provider and its payment processors to process charges in accordance with the payment terms disclosed at checkout.
The Client agrees to maintain valid payment information while payments remain due.
28. Failed or Missed Payments
Where a legitimate scheduled payment fails or is declined, the Provider may, subject to applicable law:
Retry the payment.
Request updated payment information.
Suspend access to the associated product or service.
Take reasonable steps to recover amounts validly owing.
Reasonable recovery costs may be sought where legally recoverable.
29. Refunds and Final Sales
Except where:
A specific money-back guarantee or refund policy is expressly offered with a product;
The Provider expressly agrees otherwise in writing; or
A refund, cancellation, remedy, or other entitlement is required by applicable law,
purchases of fixed-price programs and services are final.
Nothing in this section excludes rights or remedies that cannot lawfully be excluded.
Subscription cancellation terms are governed separately by the terms applicable to the relevant subscription.
30. Credit Checks and Third-Party Financing
Where a Client chooses a third-party finance or payment provider, that provider may conduct credit, identity, or eligibility checks according to its own terms and applicable law.
By choosing that payment method, the Client agrees to the applicable third-party provider's terms.
31. Lifetime Access
Where a product is advertised as including “lifetime access,” this means access for the commercial lifetime and continued availability of that particular digital product or platform, rather than the biological lifetime of the Client.
The Provider may reasonably migrate, replace, update, consolidate, or discontinue technology or content over time.
Where applicable law requires otherwise, those legal rights prevail.
Lifetime access to digital content does not create lifetime entitlement to personal coaching, live sessions, Coach Cody AI subscriptions, or other ongoing services unless expressly stated.
32. Force Majeure
The Provider is not responsible for delays or failures caused by circumstances reasonably beyond its control, including natural disasters, serious infrastructure failures, government action, telecommunications failures, pandemics, platform outages, or third-party technology failures.
33. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be severed or limited to the extent necessary while the remainder of the Terms continues in effect, where legally permitted.
34. Waiver
Failure by the Provider to enforce a provision on one occasion does not constitute a permanent waiver of that provision or any other right.
35. Governing Law
These Terms are governed by the laws applicable in New South Wales, Australia, and the laws of the Commonwealth of Australia applicable there, subject to any mandatory rights or jurisdictional protections available to a Client under applicable law.
36. Entire Agreement
These Terms, together with any product-specific terms, checkout terms, Privacy Policy, written agreement, and other terms expressly incorporated into a purchase, constitute the agreement relating to the relevant services.
Where specific written terms for a particular product conflict with these general Terms, the product-specific terms will apply to that product to the extent legally permitted.
37. Acceptance of Coach Cody AI Terms
By purchasing, accessing, or using Coach Cody AI, the User confirms that they understand and accept that:
Coach Cody AI is artificial intelligence software.
It is not Cody Butler personally.
It cannot read another person's mind.
It cannot determine another person's motivations or intentions as fact.
It cannot predict future behaviour or relationship outcomes.
Its responses can be inaccurate.
It relies substantially upon information supplied by the User.
It does not replace qualified professional services.
The User remains responsible for evaluating its responses.
The User remains responsible for their own decisions, communications, actions, and omissions.
No relationship outcome is guaranteed.
The User agrees to use Coach Cody AI as a guidance and decision-support tool rather than an authority capable of determining facts, making decisions on the User's behalf, or predicting the future.
